A Bowser versus Bowser is going down, in the courtroom to be specific. The president of Nintendo of America, Doug Bowser has recently filed a lawsuit against alleged Team Xecuter leader Gary Bowser. The lawsuit is about infringement of Nintendo’s copyright through selling and creating Nintendo Switch hacking devices.
The lawsuit was filed in Seattle court which aims to charge Bowser (nope, not the King of Koopas) with two trafficking counts and one violation in copyright, reported by Polygon. G. Bowser is allegedly operating an “international pirate ring” that sells Switch hacking devices. This allows users to avoid Nintendo’s security measures and allows them to play pirated copies of Switch games.
The lawsuit even goes way back to 2013 with G. Bowser selling hacking devices with the Nintendo 3DS and this is also not his first rodeo with Nintendo. Back in 2020, G. Bowser along Team Xecuter’s Max Louarn were both arrested and charged will at least 11 felony accounts.
This is part of Nintendo’s battle plan as they make efforts to put to stop the “serious, worsening international problem” towards piracy. According to the lawsuit, G. Bowser’s actions are placing 79 million units of Nintendo Switch and Switch Lite consoles “at risk from piracy.”
Nintendo is hoping to put Bowser’s operation to an end as they would fine him with at least $2,500 for each trafficked device and $150,000 for copyright violation.
This is not the first time Nintendo has filed cases in copyright infringement. In 2018, the company filed a case against two ROM hosting sites which they won and have been awarded $12 million. In 2020, a TikTok influencer and OnlyFans star have been sued due to Pokemon branding and merchandise.
