The SIM Card Registration Act’s rules and regulations were make public on Monday by the National Telecommunications Commission.

In October, President Ferdinand Marcos Jr signed the law requiring Filipinos to register their SIM cards. The government said this could help stop scams and other crimes. On the other hand, critics of the measure said that this could lead to privacy and data breaches.

The IRR says that subscribers have 180 days to register their SIM cards after the law goes into effect. The registration period can be extende for up to 120 days.

All SIMs must be registere, including embedde SIMs (eSIMs) and SIMs that are only for data or are use with a fixed wireless broadband modem.

If you don’t register an existing SIM within the time limit, the SIM will be turne off automatically. The deactivate SIM can only be use once it has been writte and must be use again within five days of being automatically deactivate.

Penalty

Those who present false or fictitious information or use fictitious names or fraudulent identity documents to register a SIM face up to two years in prison or a fine of up to P300,000, or both, according to the IRR.

Whoever sells or transfers a registered SIM without complying with the law’s registration requirements will be punished with imprisonment ranging from six months to six years, a fine between P100,000 and P300,000, or both.

Those who offer false or fictitious information or use fictitious names or fraudulent identity documents to register a SIM face up to two years in prison or a fine of up to P300,000, or both, according to the IRR.

Whoever sells or transfers a registered SIM without complying with the law’s registration requirements will be punished with imprisonment ranging from six months to six years, a fine between P100,000 and P300,000, or both.

Info Disclosure

“Any information and data obtaine in the registration process described under the Act shall be treate as absolutely confidential and shall not be disclosed to any person,” 

Despite the law, a telecommunications company can disclose an end-full user’s name and address in the following situations:

  • In compliance with any law requiring public telecommunications to disclose such information under the 2012 Data Privacy Act
  • Upon reasonable cause and a court order
  • Section 10 of the SIM Card Registration Act and Section 12 of IRR
  • Subscriber permission
